Privacy Policy & Terms

Pursuant to Section 30 of the NDPA 2023 and Article 9 of the GDPR, Aya processes specific categories of Sensitive Personal Data. By initializing an account, you grant explicit, unambiguous, affirmative, and revocable consent for the processing of:

• Biometric Data: Automated 3D facial geometry and liveness checks uniquely identifying your physical persona.
• Philosophical & Religious Beliefs: Explicit declarations of faith, theological viewpoints, and spiritual frameworks submitted to the Alignment Compass.
• Financial & Lifestyle Data: Personal orientations regarding household economics, marital asset structures, and lifestyle trajectories.

• The KYC Infrastructure Gateway: Aya interfaces with institutional, licensed verification processors (e.g., identity verification partners) to cross-reference National Identification Numbers (NIN), Bank Verification Numbers (BVN), and global passports.
• Data Minimization Protocol: Aya does not ingest or store your raw state-issued documentation or core identification arrays on local physical databases. Our infrastructure initiates a stateless API call to the verified identity vendor, which returns a binary verification token ("Verified" / "Failed"). The raw ID inputs are immediately discarded from memory cache layers post-transmission.
• Third-Party Liability Limitation: Aya maintains no operational, structural, or administrative control over third-party KYC platform security structures. We explicitly disclaim liability for any leak, server compromise, or administrative breach occurring at the data ingestion layers of our authorized third-party KYC providers.

• Active Account Lifetime: Data is compiled securely to render matches via the Alignment Compass algorithm.
• Erasure Flow (Designed to be Deleted): Upon your submission of an account deletion request, all corresponding profile media, alignment scoring metrics, messaging histories, and connection metadata are permanently overwritten or anonymized in our live production systems within thirty (30) calendar days.
• Regulatory Exceptions: Deletion sequences may be delayed or overridden solely if the target profile is subject to active fraud investigations, security audits, or clear law enforcement subpoenas.

• No Warranty of Outcome: The Alignment Compass is an automated tool built on probabilistic algorithmic mapping. Aya provides the service on an "As-Is" and "As-Available" basis.
• The Match Guarantee Exclusion: The Company offers no warranties—express, implied, or statutory—regarding absolute character compatibility, relational longevity, marital outcomes, or emotional success. An "Alignment Score" does not constitute an endorsement, validation, or psychological guarantee of a user's long-term sanity or behavior.

Total Liability Ceiling: To the maximum extent permitted by applicable law, the cumulative liability of Aya Technologies Ltd., its founders, directors, employees, and venture affiliates (including Tangent Cohort ecosystems) for any single claim or aggregate causes of action arising out of platform use shall be strictly limited to:

1. The total premium subscription fees paid by you to Aya in the twelve (12) months preceding the event giving rise to liability, or
2. The local currency equivalent of $100 USD (whichever is greater).

• Exclusion of Offline Event Damages: Aya maintains zero physical jurisdiction over real-world settings. The Company is completely absolved of all legal liability for any third-party criminal actions, personal injuries, psychological trauma, extortion, physical violence, or property damage occurring during offline coordinates, dates, or travel arrangements arranged between platform members.

• The Premium Infrastructure: While basic verification is required, access to premium matching pipelines may require monetary transactions. All transactions processed are final and strictly non-refundable.
• Chargeback Penalty Mechanisms: If you initiate a fraudulent or malicious billing dispute or credit card chargeback against Aya for validly rendered premium tier access, your account will face immediate and permanent termination. Your unique identity profile (NIN/Passport token) will be blacklisted across our ecosystem.

• Individual Redress Only: You explicitly agree that any legal or administrative proceedings against Aya Technologies Ltd. must be conducted purely on an individual basis. You waive any right to participate as a class representative, class member, or private attorney general in any class-action lawsuit or consolidated arbitration mechanism against the Company.

• One-Year Statute of Repose: Any cause of action or claim arising out of or relating to the use of the Aya platform must be formally commenced within one (1) year after the cause of action accrues. Failure to file within this period operates as an absolute, permanent, and unappealable legal bar to the claim.
